This Privacy Policy explains and describes Swee Technologies, Inc.’s (“Swee,” “Company,” "We", "Us" or "Our") policies and procedures on the collection, use and disclosure of Your Personal Data. We are committed to protecting your privacy and ensuring that you feel comfortable accessing and using Swee’s owned or licensed applications (“Applications”) and websites, be it https://www.swee.ai/, or any other website directly linking traffic thereto (collectively the “Websites”), along with any other technology and services provided by us (collectively with the Website and Application, the “Services”). This Privacy Policy covers the Swee’s Services and is applicable worldwide.. 

We collect and use the Personal Data and other information you provide during your interactions with Us and Our Services. We use Your Personal Data to provide and improve the Services. By using the Services, You agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy may be updated from time to time for reasons such as operational practices or regulatory changes, so we recommend that You review our Privacy Policy when returning to our Services.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Account means a unique account created for You to access our Service or parts of our Service.

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

De-Identified Data means information that cannot be used to identify You or any individual person or entity, and may include, but is not limited to: browser type, internet service provider, operating system, or device type, or information that has been aggregated or made anonymous such that it can no longer be reasonably associated with a specific person.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Personal Data is any information that can be used to individually identify a person, and may include, but is not limited to: name, email address, postal or other physical address, credit or debit card number, title, and other personally identifiable information including metadata, and user content. Personal Data does not include De-Identified Data. 

Service refers to the Application.

Service Provider means any natural or legal person who processes the data on behalf of the Swee. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Swee, to perform services related to the Service or to assist the Swee in analyzing how the Service is used.

Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Services infrastructure itself (for example, the duration of a page visit).

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

In order for You to register with Our Services, You must provide Us with your name and email at a minimum. Information from Third-Party Social Media Services

Swee allows You to create an account and log in to use the Service through the following Third-party Social Media Services:

  • Apple

If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may also have the option of sharing additional information with Swee through Your Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving Swee permission to use, share, and store it in a manner consistent with this Privacy Policy.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

Information regarding your location

Pictures and other information from your Device's camera and photo library

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to Swee's servers and/or a Service Provider's server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Use of Your Personal Data

 We will use your Personal Data only in accordance with our Privacy Policy. If you do not wish us to continue using your Personal Data in this manner, you can request that your Personal Data be deleted and your account deactivated by contacting us at support@swee.ai.

We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity (i.e. processing that is necessary for the performance of a contract with you, such as your customer agreement with us that allows us to provide you with the Services) and our “legitimate interests” or the legitimate interest of others (e.g. our users). We may use Personal Data for the following purposes:

To provide and maintain our Service, including to monitor the usage of our Service, including but not limited to administering, personalizing, improving or operating Our Services and business, better understanding Your needs and interests, and fulfilling requests You make related to the Services. We may also use Personal Data to test certain Services features, including features in development, and to generate research and reports based on Personal Data collected from use of Our Services.

To secure the Services and respond to legal obligations, including using your Personal Data in order to comply with our legal requests, orders or subpoenas, resolve disputes with users, enforce our agreements, as well as to protect, investigate and deter against fraudulent, harmful, unauthorized or illegal activity.

To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user. This may include customizing and personalizing the content and features you see, 

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service. This may include placing transactions or orders, billing and collecting payments for Our Services, and to conduct audits and provide support for Our Services. 

To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

To manage Your requests: To attend and manage Your requests to Us.

For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

We may use Your Personal Data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. If You no longer wish to receive certain communications from Us, You may opt-out of receiving them by following the unsubscribe instructions included in Our communications or by emailing us at support@swee.ai. However, You will not be able to opt-out of all communications, such as those legally required notices or required Services notices.

Sharing your Personal Data With Third Parties

Swee does not sell or rent Your Personal Data to any third party for any purpose—including for advertising or marketing purposes. Furthermore, we do not share Personal Data with any third parties except in the limited circumstances described in this Privacy Policy.

We work with vendors, service providers, and other partners to help us provide our Services by performing tasks on our behalf. We may need to share or provide information (including Personal Data) to them to help them perform these business functions, for example sending emails on our behalf, database management services, database hosting, providing customer support software, and security. These service providers do not have the right to use your Personal Data we share with them beyond what is necessary to assist us. These service providers must adhere to confidentiality and security obligations in a way that is consistent with applicable law and their own terms and policies.

Swee is responsible for the processing of Personal Data it receives in accordance with the European Commission’s Standard Contractual Clauses, and subsequent transfers to a third party acting as an agent on our behalf. We comply with the Standard Contractual Clauses, for all onward transfers of Personal Data from the EU or Switzerland, including onward transfer liability provisions.

This Privacy Policy only applies to information collected during Your use and access of the Services or any other interactions you may have with Swee. Our Services may contain links to other locations on the Internet that are not owned or controlled by Us. We are not responsible for the privacy practices of other websites or services. We encourage You to read the privacy statements of each website that collects your Personal Data.

We may also share Your Personal Data in the following situations:

  • For business transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Swee assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your Personal Data with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates may include a parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With other users: when You share Personal Data or otherwise interact in public areas, through social functions within the Services, or with other users, such Personal Data you share may be viewed by all users of the Services and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity relating to the Services. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.
  • For investigation and enforcement: We may disclose Your Personal Data to a third party where we believe, in good faith, that it is desirable to do so for the purposes of investigating, preventing, or taking action regarding suspected or actual illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, to comply with subpoenas, or as otherwise required by law. In the event that we receive a subpoena affecting your privacy, we will notify you unless prevented by applicable law, court order, rule or regulation, but are not required to quash the subpoena ourselves.
  • With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.

De-Identified Data 

We may use De-Identified Data to test features in development, and analyze the information We have to evaluate and improve products and the Services, develop new services or features, and conduct audits and troubleshooting activities. De-identified Data will have all direct and indirect personal identifiers removed. This includes, but is not limited to, name, ID numbers, and date of birth. Furthermore, We agree not to attempt to re-identify De-Identified Data and not to transfer De-Identified Data to any party unless that party agrees not to attempt to re-identify any Personal Data from such data. We may share this De-Identified Data with our affiliates, agents, advertisers, manufacturers and business partners. We may also disclose De-Identified Data in order to describe our Services to current and prospective business partners and to other third parties for other lawful purposes. Developed Data, as defined in Swee’s Terms of Service, is understood to be De-Identified Data. 

Retention of Your Personal Data

Swee will retain Your Personal Data only for as long as is necessary to provide the Services you have requested and thereafter for the purposes set out in this Privacy Policy and a variety of legitimate legal or business purposes. These might include retention periods:

  • mandated by law, contract or similar obligations applicable to our business operations;
  • for preserving, resolving, defending or enforcing our legal/contractual rights; or
  • as needed to maintain adequate and accurate business and financial records.

Swee will also retain Usage Data for internal analysis purposes. We may provide You with the opportunity to opt out of having Your Personal Data used for certain purposes when We ask for this information; however, this may limit Your ability to fully use Our Services. You may also update Your personal and security preferences by signing in to the Services. Transfer of Your Personal Data

Notice to Non-U.S. Residents

Your information, including Personal Data, is processed at Swee's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Certain aspects of the Services are operated in the United States. If You are located outside of the United States, please be aware that any information You provide to Us will be transferred to the United States. By providing Us with any information through the Site, or the Services, You consent to this transfer.

We may transfer Your Personal Data to third parties acting on Our behalf for the purposes of processing or storage. By using any of Our Services or providing any Personal Data for any of the purposes stated above, You consent to the transfer and storage of your Personal Data, whether provided by You or obtained through a third party, to the U.S. as set forth herein, including the hosting of such Personal Data on U.S. servers.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

Swee will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Disclosure of Your Personal Data

Business Transactions

If Swee is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, Swee may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

You are responsible for maintaining the strict confidentiality of your account login credentials, and for any activity that occurs under your account credentials. Notify Us if You suspect any unauthorized use of Your account or other breach of security. The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Cookies and Tracking Technologies

When You use the Services, We may collect certain information, including Personal Data, by automated or electronic means, using technologies such as cookies, browser analysis tools, web beacons, pixels, and web server logs. As you use the Services, your browser and devices communicate with servers managed by our business partners, our service providers or us to record the interactivity and to fulfill your requests for services and information.

In many cases the information We collect using such cookies and other tools is used in non-identifiable ways and without any reference to Personal Data. For example, We use information We collect about users to optimize the Services, to generate Usage Data, and to understand its traffic and usage patterns. California Law Compliance

We permit residents of California to use our Services, and fully comply with California’s privacy laws to the extent applicable to Swee’s Services. California's “Shine the Light” law (Civil Code Section § 1798.83) permits users of Our Services that are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes.   • Access: You can request more information about the Personal Data We hold about You. You can also request a copy of the Personal Data.
  • Rectification: If You believe that any Personal Data We are holding about You is incorrect or incomplete, You can request that We correct or supplement such data. You can also correct some of this information directly by logging into Your account. Please contact Us as soon as possible upon noticing any such inaccuracy or incompleteness.
  • Objection: You can contact Us to let Us know that You object to the collection or use of Your Personal Data for certain purposes.
  • Erasure: You can request that We erase some or all of Your Personal Data from Our systems.
  • Restriction of Processing: You can ask Us to restrict further processing of Your Personal Data.
  • Portability: You have the right to ask for a copy of Your Personal Data in a machine-readable format. You can also request that We transmit the data to another entity where technically feasible.

Data Protection Addendum and EC Standard Contractual Clauses

This Privacy Policy incorporates The European Commission’s Standard Contractual Clauses (or “SCCs”) a copy of which can be obtained at https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex%3A32010D0087. The SCCs are standardized contractual terms, recognized and adopted by the European Commission, with the primary purpose of ensuring that any Personal Data leaving the European Economic Area (“EEA”) will be transferred in compliance with EU data-protection law. The SCCs also incorporate the principal EU General Data Protection Regulation (GDPR) requirements covering access, disclosure, security and transparency of Personal Data, and sets forth a framework for U.S. companies, and EU entities working with U.S. companies, to meet the requirements of the GDPR. 

In certain cases, Swee will transfer Personal Data in accordance with the SCCs.

Swee, complies with the SCCs regarding the collection, use, and retention of Personal Data transferred from the European Union and Switzerland to the United States. If there is any conflict between the terms in this Privacy Policy and the SCCs, the SCCs shall govern. Both you and Swee will comply with the SCCs, so that Swee’s EU-based users can share Personal Data with Us and remain compliant with the GDPR.

We are committed to protecting Your privacy in compliance with the SCCs. EU and Swiss Individuals with inquiries or complaints regarding our Privacy Policy can contact us at support@swee.ai.

We work hard to promptly respond to any requests We receive regarding privacy and data protection. If You do not receive a timely acknowledgement of Your request from us, or if We have not addressed Your request to your satisfaction, You agree to refer the matter to the International Center for Dispute Resolution / American Arbitration Association (ICDR/AAA). ICDR/AAA is an independent recourse mechanism chosen by Swee. You may get more information or contact ICDR/AAA at https://www.icdr.org/about_icdr. The services of ICDR/AAA are provided at no cost to you. Under certain conditions, individuals may invoke binding arbitration when the dispute resolution procedures of ICDR/AAA have been exhausted.

Children's Privacy

The Services may contain content appropriate for children under the age of 13. As a parent, you should know that through the Service children under the age of 13 may participate in activities that involve the collection or use of Personal Data. We use reasonable efforts to ensure that before we collect any Personal Data from a child, the child's parent receives notice of and consents to our Personal Data practices.

We also may limit how We collect, use, and store some of the information of Users between 13 and 18 years old. In some cases, this means We will be unable to provide certain functionality of the Service to these Users. If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

We may ask a User to verify its date of birth before collecting any Personal Data from them. If the User is under the age of 13, the Service will be either blocked or redirected to a parental consent process.

Information Collected from Children Under the Age of 13

Swee may collect and store persistent identifiers such as cookies or IP addresses from Children without parental consent for the purpose of supporting the internal operation of the Service.

We may collect and store other Personal Data about children if this information is submitted by a child with prior parent consent or by the parent or guardian of the child.

Swee may collect and store the following types of Personal Data about a child when submitted by a child with prior parental consent or by the parent or guardian of the child:

Parental Access

A parent who has already given the Company permission to collect and use his child Personal Data can, at any time:
